A GLOSSARY OF LEGAL TERMS

b04

Every industry has its own language and terms. These words and phrases can be confusing to anyone who is not part of the daily operations of a specific industry, and the legal system is no exception.

To help you understand two regularly used terms in court filings, Lebovitz Law LLC. has created this handy reference guide. Here you’ll find valuable information allowing you to comprehend and communicate your legal needs effectively.

Answer or Notice of Intention to Defend.

An answer or notice of intention to defend is a response to the pleading filed against you to tell the court whether you admit or deny the allegations filed against you.

An answer is more in-depth and requires either following a court provided form or writing a separate paragraph about each line in the complaint or motion whether you admit or deny the allegations.

A notice of intention to defend applies to a complaint filed in the district court and requires either a general denial of liability for a contract action or more specific admit or deny for each line in the complaint or motion.

Failure to file an answer or notice of intention to defend can lead to a default judgment granted against you. Pay close attention to the name and location of each court and any court notices you may receive.

Also, if you move after the start or commencement of a court matter, it is your responsibility to notify the court of your new address. If you cannot attend a hearing or have a conflict, it is your responsibility to inform the court in writing and receive confirmation that you need a postponement or continuance.

However, do not assume that just because you requested a continuance or postponement that the court received the request or has granted it. If you fail to appear and the court did not receive your request or denied it, you are still responsible for any negative outcome.
